La protection des espèces sauvages en temps de conflits armés en RDC
Résumé
La protection des espèces sauvages en temps de conflits armés est juridiquement encadrée en droit congolais. Néanmoins, l'effort déjà consenti n'est pas gage d'effectivité. Il souffre des moyens de contrôle du droit des conflits armés, de l'ineffectivité inhérente au droit international environnemental, de la faible gradation des sanctions, etc. Ainsi, l'élargissement des compétences et/ou la restructuration des juridictions internationales seraient un facteur majeur dans la lutte contre la criminalité liée aux espèces sauvages. Il en est de même de la rationalisation du droit interne congolais et de la ramification du fonds d'intervention pour l'environnement.
Abstract
The protection of wild species in times of armed conflict is legally regulated under Congolese law. Nevertheless, the efforts already made do not guarantee their effectiveness. It suffers from the means of control provided by the law of armed conflict, from the ineffectiveness inherent in international environmental law, from the low gradation of sanctions, and so on. The extension of jurisdiction and/or the restructuring of international jurisdictions would therefore be a major factor in the fight against wildlife crime. The same applies to the rationalization of Congolese law and the ramification of the environmental intervention fund.
